Terms of Service
These Terms govern your use of ihatemygym.com and related emails and services (the “Service”) operated by Network Problems, LLC, a New Jersey limited liability company (“IHMG,” “we”). By using the Service you agree to these Terms and our Privacy Policy. Gym partners also agree to the Gym Partner Agreement, which controls if it conflicts with these Terms.
1. What the Service is
We help people who are unhappy with their gym find another one. You answer a quiz; we use your answers, public information about nearby gyms (including data from Google), and profiles supplied by partner gyms to suggest matches, and we let you request a visit at partner gyms. The Service is free for consumers. Partner gyms pay us a fee when a person we referred joins.
2. Eligibility and accuracy
You must be at least 18 and located in the United States. You agree to provide accurate contact information and quiz answers, to use only your own email and phone number, and not to submit requests on someone else’s behalf without permission.
3. Matches are suggestions
Match scores and explanations are generated by software, partly using artificial-intelligence tools, from the information available to us. They are opinions, not guarantees. We do not inspect gyms, verify partner-supplied profiles or offers beyond reasonable checks, or endorse any gym. Gyms marked “not a partner” have no relationship with us; their information comes from public sources and may be outdated.
4. Visits, offers, and memberships
A visit request is a request; the gym decides whether to confirm it. Any switch offer is made by the gym, not by us, and is subject to the gym’s own conditions. Any membership you buy is a contract between you and the gym. We are not a party to it and are not responsible for the gym’s facilities, staff, pricing, contracts, or cancellation terms. Read any membership agreement carefully before signing.
5. Emails and surveys
By completing the quiz you ask us to email you your results, booking updates and reminders, and short follow-up surveys asking whether you visited, joined, or switched. You can stop these at any time using the unsubscribe link in any email. Transactional emails needed to complete a booking you requested may still be sent. Your survey answers may be shared with the gym you visited and are used to determine whether the gym owes us a fee.
6. Information we share with gyms
When you request a visit at a partner gym, we share your name, email, phone number, requested visit time, and your quiz answers (including your reasons for leaving your current gym and any note you wrote) with that gym so it can host your visit. We do not share your information with gyms you did not request to visit. See the Privacy Policy for details.
7. Acceptable use
You may not use the Service to harass anyone, submit false information, scrape or copy our content or data, interfere with the Service, or claim a gym you do not own or manage. We may suspend access for violations.
8. Intellectual property
The Service, including its quiz, matching logic, text, and design, is owned by IHMG or its licensors. Gym names and logos belong to their owners. Map and place data are provided by Google and subject to Google’s terms.
9. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, IHMG IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY INJURY, LOSS, OR DISPUTE ARISING FROM YOUR VISIT TO OR MEMBERSHIP AT ANY GYM. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED $100. Some states do not allow certain limitations, so some of these may not apply to you.
10. Governing law; disputes
These Terms are governed by New Jersey law. Disputes will be resolved exclusively in the state or federal courts located in Monmouth County, New Jersey, except that either party may bring an eligible claim in small-claims court. You and IHMG each waive trial by jury and agree that claims must be brought individually, not as a class or representative action.
11. Changes and contact
We may update these Terms by posting a new version with a new effective date. Continued use after that date is acceptance. Questions: contact@ihatemygym.com.
